HEALTH AND SAFETY

Construction (Use of Explosives) (Amendment) Regulations (Northern Ireland) 2007

  To be laid before Parliament
  Coming into operation 9th July 2007 

The Secretary of State, in exercise of the powers conferred by Articles 17(1) to (6), 40(2) to (4), 43(3), 54 and 55(2) of and paragraphs 1,2,3,5,6,11,13,14(1), 15 and 19 of Schedule 3 to the Health and Safety at Work (Northern Ireland) Order 1978[1] as so applied and modified, and after consultation in accordance with Article 46(1) of that Order with the Health and Safety Executive for Northern Ireland and such other bodies as appear to him to be appropriate, makes the following Regulations:–

Citation and commencement
     1. These Regulations may be cited as the Construction (Use of Explosives) (Amendment) Regulations (Northern Ireland) 2007 and shall come into operation on 9th July 2007.

Amendment of the Construction (Use of Explosives) Regulations (Northern Ireland) 1997
    
2. The Construction (Use of Explosives) Regulations (Northern Ireland) 1997[2] shall be amended in accordance with Schedule 1.

EXPLANATORY NOTE

(This note is not part of the Regulations)


     1. These Regulations amend the Construction (Use of Explosives) Regulations (Northern Ireland) 1997 (S.R. 1997 No. 555) to align them to the Construction (Design and Management) Regulations (Northern Ireland) 2007 (S.R. 2007 No.291).

     2. Schedule 1, paragraph 1 redefines (a) a "construction site"; (b) "construction work"; and (c) a "structure".

     3. Schedule 1, paragraph 2 requires explosives to be stored, transported and used safely and securely, so far as is reasonably practicable.

     4. In Great Britain the corresponding Regulations are the Construction (Design and Management) Regulations 2007 (S.I. 2007/320). The Great Britain Health and Safety Executive have prepared a full regulatory impact assessment in relation to these Regulations. A copy of that assessment together with a Northern Ireland Supplement prepared by the Health and Safety Executive for Northern Ireland is held at the offices of that Executive at 83 Ladas Drive, Belfast BT6 9FR from where a copy may be obtained on request.
