The Weights and Measures (Metrication Amendments) Regulations (Northern Ireland) 2010

The Department of Enterprise, Trade and Investment(1) makes the following Regulations in exercise of the powers conferred by Articles 9(1) to (4), 10(6) and 13(1) of the Weights and Measures (Northern Ireland) Order 1981(2) and now vested in it (3).

Citation and commencement

1. These Regulations may be cited as the Weights and Measures (Metrication Amendments) Regulations (Northern Ireland) 2010 and shall come into operation on 6th December 2010.

Interpretation

2. In these Regulations, -�the 2006 Regulations-� means the Weighing Equipment (Beltweighers) Regulations (Northern Ireland) 2006(4).

Removal of time limit on the use of supplementary indications

3.-�(1) Each of the provisions listed in paragraph (2) shall be amended by omitting the words -�until 31st December 2009-�.

(2) Those provisions are-�

(a)regulations 11A and 16A of the Measuring Equipment (Liquid Fuel by Road Tanker) Regulations (Northern Ireland) 1984(5);

(b)regulation 7A of the Measuring Equipment (Intoxicating Liquor) Regulations (Northern Ireland) 1984(6);

(c)regulation 17A of the Measuring Equipment (Measures of Length) Regulations (Northern Ireland) 1986(7);

(d)regulation 12A of the Weighing Equipment (Filling and Discontinuous Totalising Automatic Weighing Machines) Regulations (Northern Ireland)1986(8);

(e)regulation 10(7) of the Capacity Serving Measures (Intoxicating Liquor) Regulations (Northern Ireland) 1993(9);

(f)regulation 16(7)(b) of the Measuring Equipment (Capacity Measures) Regulations (Northern Ireland) 1998(10);

(g)regulation 6(4) of the Measuring Equipment (Liquid Fuel and Lubricants) Regulations (Northern Ireland) 1998(11);

(h)regulation 7 of the Weighing Equipment (Automatic Catchweighing Instruments) Regulations (Northern Ireland) 2006(12); and

(i)regulation 8(2) of the 2006 Regulations.

(3) Regulation 7 of the Weighing Equipment (Automatic Gravimetric Filling Instruments) Regulations (Northern Ireland) 2005(13) and regulation 18 of the Weighing Equipment (Non-automatic Weighing Machines) Regulations (Northern Ireland) 2006(14) shall each be amended by omitting the words -�up to and including 31st December 2009-�.

Revocation

4. The Weights and Measures (Metrication Amendments) Regulations (Northern Ireland) 2002(15) are revoked.

Modification of the Weighing Equipment (Beltweighers) Regulations (Northern Ireland) 1985

5. Regulation 13A of the Weighing Equipment (Beltweighers) Regulations (Northern Ireland) 1985(16), so far as remaining in operation by virtue of regulation 1(3) of the 2006 Regulations, is to be read as if the words -�until 31st December 2009-� were omitted.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations implement in part the amendments made by Directive 2009/3/EC of the European Parliament and the Council (OJ L114, 7.5.2009, p 10) to Council Directive 80/181/EEC (OJ L39, 15.2.1980, p 40) which relates to the use of units of measurement.

Regulation 3 removes the time limit on the use of supplementary indications of quantity expressed in imperial units of measurement (31st December 2009) which is provided for in the regulations there listed. The use of such supplementary indications is, therefore, permitted indefinitely.

In consequence of provision in regulation 3, regulation 4 revokes the Weights and Measures (Metrication Amendments) Regulations (Northern Ireland) 2002, which inserted the 31st December 2009 time limit in question.

Regulation 5 modifies the Weighing Equipment (Beltweighers) Regulations (Northern Ireland) 1985 so that, where they continue to apply to beltweighers passed as fit for use for trade prior to 1st June 2006, they are read as if the 31st December 2009 time limit were omitted.

A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
