Dangerous Drugs

The Misuse of Drugs (Safe Custody) (Amendment) Regulations (Northern Ireland) 2011

The Department of Health, Social Services and Public Safety makes the following Regulations in exercise of the powers conferred by sections 10(2)(a) and 31 of the Misuse of Drugs Act 1971(1), as adapted by sections 31(4) and 38 of that Act and now vested in it (2) and after consultation with the Advisory Council on the Misuse of Drugs in accordance with section 31(3) of that Act.

Citation and commencement

1. These Regulations may be cited as the Misuse of Drugs (Safe Custody) (Amendment) Regulations (Northern Ireland) 2011 and shall come into operation on 1st April 2011.

Interpretation

2.-(1) In these Regulations "the 1973 Regulations" means the Misuse of Drugs (Safe Custody) (Northern Ireland) Regulations 1973 (3).

(2) The Interpretation Act (Northern Ireland) 1954(4) shall apply to these Regulations as it applies to an Act of the Assembly.

Amendment to the 1973 Regulations

3. For paragraph (6) of regulation 4 of the 1973 Regulations substitute-

"(6) a certificate shall, unless previously cancelled in pursuance of paragraph (5), remain in force for a period of five years from the date of issue."

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend regulation 4(6) of the Misuse of Drugs (Safe Custody) (Northern Ireland) Regulations 1973 to increase the period for which a security certificate of exemption remains in force.

Current certificates remain in force for a period of one year from the date of issue thereof, but may from time to time be renewed for a further period of one year. The amended wording of the certificate allows it to remain in force for a period of five years from the date of issue.

An impact assessment has not been prepared in respect of this Statutory Rule as it has no significant impact on the cost of business, charity or voluntary bodies.
