Road Traffic And Vehicles

The Motor Vehicles (Access to Driver Licensing Records) Regulations (Northern Ireland) 2022

The Department for Infrastructure ( 1) makes the following Regulations in exercise of the powers conferred by Articles 19I and 218 of the Road Traffic (Northern Ireland) Order 1981( 2) and now vested in it( 3).

Citation and commencement

1.  These Regulations may be cited as the Motor Vehicles (Access to Driver Licensing Records) Regulations (Northern Ireland) 2022 and shall come into operation on 1stDecember 2022.

Interpretation

2.  In these Regulations “ the 1981 Order” means Road Traffic (Northern Ireland) Order 1981.

Access to driver licensing information

3.—(1) The Department for Infrastructure may make information held by it for the purposes of Part 2 of the 1981 Order available to persons employed by the authorities of any country or territory outside the United Kingdom with responsibility under the law of that country or territory for the regulation of drivers or vehicles, provided that country or territory has entered into an agreement with the United Kingdom for the sharing of such information or has been designated for the purpose of licence exchange under Article 19D(2) of the 1981 Order.

(2) The purpose for which persons specified in paragraph (1) may be given access to information made available to them under that paragraph is the discharge of responsibilities for the regulation of drivers or vehicles.

(3) The purposes for which persons may be given access to information under the Motor Vehicles (Access to Driver Licensing Records) Regulations (Northern Ireland) 2011( 4) do not apply to persons specified in paragraph (1).

EXPLANATORY NOTE

(This note is not part of the Regulations)

Article 19I of the Road Traffic (Northern Ireland) Order 1981 makes provision for access to driver licensing information. These Regulations will further allow for the sharing of driver licensing information with each country or territory that the United Kingdom has entered into an agreement for the sharing of such information and also those countries or territories which have been designated for the purpose of exchanging driver licences. The Regulations also determine that the purpose of providing access to driver licensing information is restricted to the discharge of responsibilities for the regulation of drivers or vehicles.
