Subject_Judicial Factor—Curator Bonis.—
Circumstances in which authority granted to the curator bonis of an idiot to make up titles to a land-estate in his person.
Application by the curator bonis of James M'Donald of Morar, an idiot, for authority to make up titles to the estate of Morar, and thereafter to borrow money, and dispone the estate in security. It was stated that the free rental was about £240, and that creditors, holding debts to the amount of £3182, 2s., threatened to lead adjudications, which, could not be prevented, except by making up titles, and effecting a heritable loan. 1
The Court granted power to make up titles; and, in the mean time, superseded quoad ultra.
