The Local Governance (Scotland) Act 2004 (Remuneration) Amendment Regulations 2013

The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 11 and 16(2) of the Local Governance (Scotland) Act 2004(1) and all other powers enabling them to do so.

Citation and commencement

1.  These Regulations may be cited as the Local Governance (Scotland) Act 2004 (Remuneration) Amendment Regulations 2013 and come into force on 18th February 2014.

Amendment of the Local Governance (Scotland) Act 2004 (Remuneration) Regulations 2007

2.  (1)  The Local Governance (Scotland) Act 2004 (Remuneration) Regulations 2007(2) are amended in accordance with the following paragraphs.

(2) For the table in regulation 6(2) (remuneration of the Leader of the Council) substitute-

"for the year ending 31st March 2014

from 1st April 2014

(a) Band A–£27,329£27,602
(b) Band B–£32,795£33,123
(c) Band C–£38,259£38,642
(d) Band D–£49,191£49,683".

(3) For the table in regulation 7(2) (remuneration of the Civic Head) substitute-

"for the year ending 31st March 2014

from 1st April 2014

(a) Band A–£20,497£20,702
(b) Band B–£24,596£24,842
(c) Band C–£28,694£28,982
(d) Band D–£36,893£37,262".

(4) In regulation 10 (councillors' remuneration)-

(a)in paragraph (a) for "2009 - £15,838" substitute "2014 - £16,396";

(b)in paragraph (b) for "2009 - £16,234" substitute "2014 - £16,560".

(5) In regulation 12 (joint boards)-

(a)in paragraph (8) for "2009 of £19,799 and, from 1st April 2009, of £20,294" substitute "2014 of £20,497 and, from 1st April 2014, of £20,702";

(b)in paragraph (9) for "2009 of £18,809 and, from 1st April 2009, of £19,279" substitute "2014 of £19,472 and, from 1st April 2014, of £19,667".

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Local Governance (Scotland) Act 2004 (Remuneration) Regulations 2007. They substitute increased amounts for different categories of local authority remuneration to their members, for the year to 31st March 2014 and from 1st April 2014.

The provisions made for the year to 31st March 2014 have the effect of allowing local authorities to pay members in their various capacities increased remuneration for the current year. Further, the provisions for the period from 1st April 2014 allow local authorities to increase councillor remuneration from that date.

Regulation 2(2) makes provision for Council Leaders' remuneration.

Regulation 2(3) provides new maximum levels for remuneration of Civic Heads. It is for each local authority to determine whether and to what extent such remuneration should be paid.

Regulation 2(4) sets new levels for Councillor remuneration.

Regulation 2(5) sets new levels of remuneration for councillors who perform the role of convener or vice convener of a joint board.
