DETERMINATION AND REASONS

 

1.             At the commencement of the hearing, Ms Fujiwala, who appeared on behalf of the Secretary of State, withdrew the grounds of challenge to the decision of the First-tier Tribunal allowing the appellant’s appeal.

 

2.             There being no effective challenge to the First-tier Tribunal Judge’s determination, the Upper Tribunal is bound to find no error on a point of law has been established.

 

DECISION

 

The Judge made no error on a point of law and the original determination of the appeal shall stand.
