    JUDGE BUTTER QC: We are grateful to Mr Lewis in this case, who in our view has correctly identified an arguable point of law, namely that in the light of the Davidson case and the Seymore-Smith cases, the Tribunal below ought arguably to have agreed for the matter to be reinstated and the application arguably should not have been dismissed as it was.

    In the circumstances we propose to direct that the matter do proceed to a full hearing and we give leave for the Appellant to amend the Notice of Appeal within 14 days of today. the appeal itself will have to follow the normal procedure of this Tribunal in relation to the Seymore-Smith line of cases.

    We will further direct that the skeleton arguments be exchanged 14 days before the date of the hearing of the appeal, whenever that might be.
