    JUDGE PETER CLARK: The question in this appeal is whether the Industrial Tribunal Chairman hearing the preliminary issue as to whether the Appellant's complaint was out of time failed to determine whether there was a continuing act of sex discrimination or victimisation which brought the complaint within time.

    We think that the grounds of appeal advanced by Mr Cato are arguable and consequently we shall direct that the appeal proceed to a full hearing to be listed for half a day, Category C, to be heard on either a Wednesday, Thursday or Friday, and that there be exchange of skeleton arguments between the parties, copies to be lodged with the EAT, not less than 14 days before the date fixed for the full appeal hearing.
