UPON the Information Commissioner not seeking to contest the appeal;
AND UPON noting that the withheld information has already been released to the appellant:
1. At the parties’ request, the appeal is ended on terms of consent:
1.1 The appeal is allowed;
1.2 This decision substitutes the one issued by the Information Commissioner’s Office on 28 February 2020, number FS50857816:
1.2.1 Swansea Council was not entitled to withhold the information because the exemption under section 31(1)(g) of the Freedom of Information Act 2000 in conjunction with section 31(2)(c) is not engaged.
1.2.2 Even if the aforementioned exemption were engaged, under section 2(2)(b) of the Freedom of Information Act 2000, the public interest in disclosing the information would outweigh the public interest in maintaining the exemption.
This decision was made by the Tribunal Registrar. A party is entitled to apply in writing within 14 calendar days of the date this document is sent for this decision to be considered afresh. If you apply later than 14 days you must explain why you are late.
