(1) Markos Chrysostomou (2) Julie Chrysostomou v (1) John Patrick Kennedy (2) Caroline Kennedy (Adverse possession : Factual possession) [2019] UKFTT 249 (PC) (06 March 2019)
[2019] UKFTT 249 (PC). Application for adverse possession of an area of land to the rear of a property in Barnet. The registered owners owned a large area of land, including the disputed area, which had been allowed to grow wild pending several unsuccessful planning applications. The Applicants had used the disputed land as part of their garden since 1997. It is fenced on three sides and effectively inaccessible from the remaining side, where it joined the rest of the land owned by the Respondents. The land has been used as a vegetable garden. The Respondents did not require the Applicants to satisfy one of the three conditions in paragraph 5 of Schedule 6. The application succeeded.
