Summary: The complainant wrote to the Mersey Docks and Harbour Company (the -MDHC-) and requested information relating to a landing stage which sunk in 2006. The MDHC refused to comply with the request, claiming that it did not constitute a public authority for the purposes of the Environmental Information Regulations 2004 (the -EIR-). The Commissioner has considered the case and has decided that the MDHC is a public authority under the EIR and as such is required to consider whether the requested information is environmental information, and if so to respond to the request.
