Summary: The complainant made a request for information to the City of Westminster (-the Council-) on 19 January 2008 for a copy of all correspondence and documentation regarding the commissioning, production and issuing of a fire risk assessment report. The Council refused to comply with the request on the grounds that it considered it to be vexatious under section 14 of the Freedom of Information Act 2000 (-the Act-). The Commissioner investigated and found that the Council did not provide sufficient evidence for section 14(1) of the Act to be engaged. The Commissioner also found that the Council breached section 17(5) of the Act for not issuing the refusal notice within the statutory time limit. The Council is required to confirm or deny to the complainant if the information requested is held and either disclose this information to the complainant or provide him with a valid refusal notice in accordance with the requirements of section 17(1) of the Act.
