Summary: The complainant requested information he believed was held by the Office of Fair Trading (the -OFT-) concerning a competition for the Consumer Journalist of the Year Award in November 2007. The OFT had been involved in the competition. The Commissioner finds that the OFT correctly applied section 40(2) - personal information, and section 42 - legal professional privilege to the information it did hold. The Commissioner is also satisfied on a balance of probabilities that the OFT does not hold the remaining information requested by the complainant and therefore does not require the authority to take any steps. However, the Commissioner finds that the OFT has not met the requirements of section 10(1) and section 17(1) of the Act. This decision notice is currently under appeal to the Information Tribunal.
