Summary: The complainant requested the names of councillors who were members of the Local Government Pension Scheme (LGPS) but the request was refused by Buckinghamshire County Council (BCC) because the information was exempt under section 40(2) of the Act. The decision was upheld following internal review. During the Commissioner-™s investigation, five of the councillors who were members of the LGPS gave consent for their names to be disclosed. With regard to the names of the remaining ten councillors who were members, the Commissioner has decided that BCC was not entitled to rely on section 40(2) of the Act to withhold their names.
