Summary: The complainant requested copies of -Any document or legal opinion of the dept of the DWP referred to in Para 21 of the explanatory notes [provided to Parliament in support of the Health and Safety (Offences) Bill]-. The requested information was refused by the Department for Work and Pensions (DWP) on the grounds of the exemption provided by section 42(1) of the Act, relating to legal professional privilege. The Commissioner-s decision is that the refused information attracts legal professional privilege and in all the circumstances of the case, the public interest in maintaining the exemption outweighs the public interest in disclosure. Information Tribunal appeal number EA/2010/0044 has been dismissed.
