Summary: The complainant requested information about the circumstances relating to the departure of a former Solicitor to the Authority. The Authority refused the request under section 40(2) of the Act on the basis that it was personal data and disclosure would breach the first data protection principle. The Commissioner has investigated and finds that the Authority correctly applied section 40(2) of the Act. The Commissioner has also identified a number of procedural shortcomings in the way the Authority handled the complainant-™s request. Information Tribunal appeal number EA/2010/0130 part-allowed.
