The Commissioner-™s decision is that the public authority-™s response constitutes a denial that it holds information of the description specified in the request and that, on the balance of probabilities, he is satisfied that no information is held. In providing its response later than 20 working days from its receipt of the request, the public authority breached section 10(1) of the Freedom of Information Act. The Commissioner requires no action to be taken. Information Tribunal appeal number EA/2010/0164 struck out.
