Summary: The complainant requested information relating to an opinion poll entitled -˜Public Perceptions of the Executive-™. OFMDFM disclosed some of the information requested but withheld other information citing section 43(2) of the Act. The Commissioner-™s decision in this case is that the exemption under section 43(2) is not engaged and that the information should be disclosed. The Commissioner has also recorded a number of procedural breaches in relation to OFMDFM-™s handling of this request.
