Summary: The complainant asked the Council for information relating to tender bids from a private company for a large Council redevelopment project. The Council responded to the complainant-s request and disclosed some of the requested information, however it refused to disclose the remainder (-the withheld information-) citing section 43(2) of the FOIA. The Commissioner concluded in this case that the withheld information was exempt from disclosure under section 43(2) of the FOIA. The Commissioner is also satisfied that the public interest favours maintaining the section 43(2) exemption. The Commissioner has ordered no steps to be taken.
