Summary: The complainant requested certain types of information relating to sergeants at Hillingdon Borough, including badge numbers of sergeants on duty on three days in July 2007. The public authority disclosed some information but refused to provide the remainder citing the exemptions at section 31 (Law enforcement) and section 40 (Unfair disclosure of personal data) as its bases for doing so. It disclosed further information on internal review but continued to withhold badge numbers of sergeants on duty on the three days in July 2007 citing the same exemptions apart from one of the provisions of section 31 that it had previously cited. In correspondence with the Commissioner it withdrew reliance on any of the provisions of section 31. The Commissioner has decided that the public authority is not entitled to rely on section 40(2) as a basis for withholding the remaining information. In failing to provide this information within 20 working days the public authority contravened the requirements of section 1(1) and section 10(1) of the Act.
