Summary: The complainant requested, from the Crown Prosecution Service (CPS), prosecution paperwork and all witness statements for a particular case. The CPS confirmed it held the requested information but refused to provide it on the basis that it was exempt from disclosure by virtue of sections 30 (investigations and proceedings), 40(2) (personal information) and 42 (legal professional privilege). The complainant subsequently narrowed the scope of his request to specific witness statements only. As the Commissioner has decided that the information requested is exempt from disclosure under section 40(2) of the Act he has not considered the other exemptions. He requires no remedial steps to be taken in this case.
