Summary: The complainant made a request for background notes to 45 Parliamentary Questions about the Tasker Report. The MoJ provided some of the requested information but withheld the remainder under section 36(2)(b) of the Freedom of Information Act 2000. It made a late introduction of section 40(2) at the internal review stage. The Information Commissioner found that some of the information was correctly withheld under section 36(2)(b), and that section 40(2) was correctly applied to some of the information. The Commissioner requires the MoJ to disclose some of the information withheld under sections 36 and 40. He also found procedural breaches of the Act. Information Tribunal appeal number EA/2011/0267 dismissed.
