Summary: The complainant requested a copy of legal advice in relation to the Council-™s decision to accept a named premises as a hotel. The Council confirmed that it held the requested information, but stated that it was exempt from disclosure by virtue of section 42(1) of the Act. The Commissioner finds that the Council was entitled to withhold the information by virtue of section 42(1). He has found that the exemption was engaged and that the balance of public interest favours maintaining the exemption. He requires no remedial steps to be taken in this case.
