Summary: The complainant has requested the legal advice received by DEFRA to inform its decision as to whether it should pursue prosecutions of particular named abattoir owners. DEFRA withheld the requested information under section 30(1)(C) and section 42 of the Freedom of Information Act 2000 (FOIA). The Commissioner-™s decision is that DEFRA has correctly applied section 42 FOIA to withhold the requested legal advice. The Commissioner requires no steps to be taken.
