Summary: The complainant has requested the minutes of a meeting held between Otley Town Council and third parties. The Commissioner-™s decision is that the council applied the Freedom of Information Act when considering the request but the information is in fact environmental information. The council should therefore have considered the information under the Environmental Information Regulations 2004. The Commissioner requires the public authority to consider the request for information under the Environmental Information Regulations 2004 and to issue a fresh response to the complainant.
