Summary: The complainant requested risk assessments carried out on the seafront by Portsmouth City Council in the last 2 years. The council initially stated that no such assessments existed, but subsequently a risk assessment was provided to the complainant dated 2010. This was provided to the complainant outside of the 20 day period required by section 10(1) of the Act. The Commissioner-™s decision is that Portsmouth City Council has breached section 10(1). The Commissioner does not require the authority to take any steps.
