Summary: The complainant has requested copies of the transcripts of those parts of the [named doctor] hearing that were held in private. The General Medical Council (GMC) refused to provide the requested information under section 40(2) of the Freedom of Information Act 2000 (FOIA) by virtue of section 40(3)(a)(i) FOIA. The Commissioner-™s decision is that the GMC correctly withheld the requested information under section 40(2) by virtue of section 40(3)(a)(i) FOIA. The Commissioner requires no steps to be taken. This decision notice is currently under appeal to the Information Tribunal.
