Summary: The complainant made a freedom of information request to the Department for Communities and Local Government (DCLG) for information regarding tenancy deposit schemes. DCLG refused the request by relying on the exemptions in section 36(2)(b)(i) (inhibit free and frank provision of advice); section 42 (legal professional privilege) and section 43(2) (commercial interests). The Commissioner has investigated the complaint and found that the exemptions apply and that in each case the public interest in maintaining the exemption outweighs the public interest in disclosure. The Commissioner requires no steps to be taken.
