Summary: The complainant requested from the General Dental Council (-GDC-) information about the investigation of a complaint that he made about a dentist. The GDC disclosed some information but withheld other information under various exemptions under FOIA. The complainant complained that the GDC had interpreted the scope of his request too narrowly and had withheld information that should have been disclosed to him. The Commissioner made an initially determination as to whether the GDC had correctly interpreted the scope of the request. The Commissioner-s decision is that the GDC has correctly interpreted the scope of the complainant-s request. He therefore does not require the GDC to take any further steps to ensure compliance with the legislation in relation to its interpretation of the scope of the request. However, he has found that by not responding promptly to the complainant-s request, the GDC breached section 10 of FOIA.
