The complainant has requested a copy of the tender report and information with regard to a grant application for a named property within the boundaries of Pembrokeshire County Council (‘the Council’). The Council provided some information but refused to disclose the remainder by virtue of section 43(2) of the FOIA. The Commissioner’s decision is that the Council has correctly relied on section 43(2) of the FOIA in respect of most of the information. However, it should have relied on section 40(2) of the FOIA in respect of the names of some individuals within the Tender Report. The Commissioner does not require the public authority to take any steps.
