Summary: The complainant requested information in respect of two documents which the Public Service Ombudsman for Wales (-˜the PSOW-™) had previously refused to provide in response to a subject access request. The PSOW refused to disclose them by virtue of section 40(2) and section 44(1) of the FOIA. The Commissioner-™s decision is that the PSOW correctly relied on section 40(2) of the FOIA in relation to these documents. The Commissioner requires no steps to be taken.
