The complainant has requested information about Rugby Borough Council’s monitoring of building work at an adjoining property. The Council refused the request, stating that the information was exempt from disclosure under section 40(2) of the FOIA. The Information Commissioner’s decision is that the Council was correct to refuse the request as the exemption provided by section 40(2) of the FOIA was engaged.
