The complainant has requested information about Kirby Muxloe Parish Council correspondence and papers relating to a particular Parish Council meeting. Kirby Muxloe Parish Council has, at the date of this notice, yet to provide a substantive response to the requests. The Commissioner’s decision is that Kirby Muxloe Parish Council has breached section 1, (right of access) section 10 (time for compliance) and section 17 (refusal of request) of the FOIA because it has failed to provide a valid response to the requests within 20 working days of receiving them. The Commissioner requires the public authority to issue a response to both requests under the FOIA.
