The complainant submitted a four-part request for information to Allerdale Borough Council. The information sought by the complainant concerns the Council’s financial support for the Taste Cumbria Food Festival and also for information relating to the legal position of the Council in respect of the closure of roads during that event and similar events. The Commissioner’s decision is that the Council does not hold any information relevant to item A of the complainant’s request: He has decided that the Council is entitled to rely in section 22(1) of the FOIA in respect of item B of the request and that it is also entitled to rely on section 42(1) in respect of item C of the request. In respect of item D of the request, the Commissioner has decided that the Council has breached section 10 of the FOIA. He requires the Council to issue a new refusal notice to the complainant which is compliant with section 17 of the FOIA.
