The complainant has requested a copy of the report regarding Therapeutic Management of Aggression and Violence (TMAV), provided in March 2012, by the accrediting organisation, to the Trust before the TMAV training was disbanded. Cornwall Partnership NHS Foundation Trust (the Trust) refused to provide the requested information under section 36(2)(b)(i) and (ii), section 36(2)(c) and section 40(2) of the of the Freedom of Information Act 2000 (FOIA). The Commissioner’s decision is that the Trust has correctly applied section 36(2)(b)(ii) to the withheld information. The Commissioner requires no steps to be taken. Information Tribunal appeal EA/2014/0199 allowed.
