The complainant wants to know why Rotherham NHS Foundation Trust’s current Medical Director is absent from the role, and who is undertaking the role in their absence. The Trust released information in relation to the second part of the request but withheld the first part, citing section 40(2) of the FOIA (personal data of a third person). The Commissioner’s decision is that Rotherham NHS Foundation Trust has correctly applied section 40(2) to the withheld information. It does not need to take any further steps.
