The complainant requested from Llanfachraeth Community Council (‘the Council’) copies of correspondence between the Council and Hacker Young, an external auditor. In its initial response the Council stated that the correspondence was held but did not disclose it or issue a refusal notice. During the course of the Commissioner’s investigation, the Council stated that it did not hold the information requested. The Commissioner is satisfied that on the balance of probabilities the Council does not hold the requested information. However, the Council breached sections 1(1)(a) and 10 of the FOIA by failing to deny that it held the information requested within 20 working days. The Commissioner does not require any steps to be taken.
