The complainant has requested information relating to costs for Building Control and Land Charges information. The Commissioner’s decision is that the Borough Council of King’s Lynn & West Norfolk has not provided sufficient evidence to apply the exemption where disclosure would prejudice the commercial interests of any person at section 43(2) of the FOIA. He has also decided that, on the balance of probabilities, the Borough Council of King’s Lynn & West Norfolk does not hold any further information in relation to the request. The Commissioner requires the public authority to disclose the information withheld under section 43(2).
