The complainant submitted a request to the Ministry of Defence (MOD) seeking a copy of the 2014 Safety Report for the Redcliffe Bay Petroleum Storage Depot. The MOD initially sought to withhold this information on the basis of regulation 12(4)(d) (incomplete material). However at the internal review stage the MOD disclosed the requested information albeit with redactions made on the basis of regulations 12(5)(a) (national security and public safety) and 13(1) (personal data). The Commissioner is satisfied that the redacted information is exempt from disclosure on the basis of regulation 12(5)(a). However, he has concluded that the MOD breached regulation 11(4) of the EIR by failing to complete its internal review within 40 working days.
