The complainant has requested copies of emails and correspondence regarding an earlier request for information which she had made which the council was still considering. The council refused the request on the basis that section 14 of the Act applies. The Commissioner’s decision is that the council was not correct to apply section 14 in this instance. He has also decided that the council breached section 10(1) of the Act in that it did not respond to the request within 20 working days. The Commissioner requires the public authority to consider the request as required by section 1 of the Act without applying section 14.
