The complainant has requested information relating to Tees Valley Airport. Tees Valley Combined Authority (“TVCA”) initially handled this request under the FOIA and refused to provide information relating to one of the requests citing section 43 (commercial interests exemption). It upheld this position at internal review. During the course of the Commissioner’s investigation and at the request of the Commissioner, it stated reliance on EIR regulation 12(5)(e) (confidentiality of commercial or industrial information). The Commissioner’s decision is that TVCA is entitled to rely on regulation 12(5)(e) in respect of the information it has withheld from disclosure. No steps are required.
