The complainant made requests for information relating to the funding of the Mersey tunnel. Merseytravel refused the request as vexatious under section 14(1) and during the Commissioner’s investigation cited section 14(2) of the FOIA to the second part of the request. The Commissioner’s decision is that Merseytravel has correctly applied the vexatious provision at section 14(1) of the FOIA to the whole of the request but has incorrectly applied 14(2) of the FOIA to the second part of the request. She does not require any steps to be taken. This decision notice is currently under appeal to the Tribunal.
