The complainant requested a copy of a grievance report which was discussed by the council on 27 June 2016. The council refused the request on the basis that it had received a letter from a solicitor threatening legal action if the document was disclosed. The Commissioner’s decision is that the information is exempt under section 40(2) of the Act. The Commissioner does not require the council to take any steps. This decision notice is currently under appeal to the Tribunal.
