The complainant requested information relating to the Rotherham Development Plan. Rotherham Metropolitan Borough Council (the Council) cited section 21 of the FOIA (information accessible to applicant by other means). The Commissioner’s decision is that section 21(1) is not engaged. The Commissioner requires the Council to take the following steps to ensure compliance with the legislation: issue a fresh response under the FOIA or EIR.
