Rotherham Metropolitan Borough Council

The complainant has requested information about the expert guidance that has been sought by Rotherham Metropolitan Borough Council in making a decision. The Council refused to comply with the request under section 14(1). The complainant subsequently contested the application of section 14(1). The Commissioner’s decision is that the Council has correctly applied section 14(1). However, the Council breached section 17(1) by providing its refusal notice outside of the time for compliance. The Commissioner does not require the public authority to take any steps.
