The complainant has requested information on the number and distribution of Ministerial Misconduct complaints. The Cabinet Office disclosed information in relation to questions one and three, withheld the information falling within the scope of question two under section 40(2) and confirmed that the information requested in question four was already in the public domain and relied on section 21 to refuse to provide this information. The Commissioner’s decision is that the Cabinet Office is entitled to rely on section 40(2) to withhold the information within the scope of question two, the Cabinet Office does not hold any further information within the scope of question three and is not entitled to rely on section 21 in relation to question four. The Commissioner requires the public authority to disclose the information withheld and section 21. The public authority must take these steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
