Rotherham Metropolitan Borough Council

The complainant has asked Rotherham Metropolitan Borough Council for all forms of recorded information associated with its Register of Members Interests, in particular that information which concerns the Council and councillors who registered as members of UKIP or the Brexit Party. The Council refused to comply with the complainant’s request in reliance on the exemption to disclosure provided by section 40(2) of the FOIA. The Commissioner’s decision is that Rotherham Metropolitan Borough Council has correctly applied the section 40(2) exemption to the information it holds which falls within the terms of the complainant’s request.
