Cheshire East Council

The complainant requested information from Cheshire East Council (“the Council”) about a right of way. The Council considered that the request was too burdensome and refused it under regulation 12(4)(b) of the EIR: Manifestly unreasonable requests. The Commissioner’s decision is that the exception at regulation 12(4)(b) is engaged and that the balance of the public interests favours the exception being maintained. The Commissioner does not require the Council to take any steps.

EIR 12(4)(b): Complaint not upheld

Decision notice: 123425
