North Yorkshire County Council

The complainant requested information about planning applications for Heavy Goods Vehicle Operating Centres. North Yorkshire County Council (the “council”) refused the request as manifestly unreasonable under the terms of regulation 12(4)(b). The Commissioner’s decision is that the council is entitled to rely on regulation 12(4)(b) of the EIR to refuse to comply with the request but that it breached regulation 11 by failing to conduct an internal review within 40 working days. The Commissioner does not require the council to take any steps.
